1. Agreement

By downloading, installing, or using Race Marks ("the App"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the App.

2. The Service

Race Marks is a sailing course navigation app that provides course cards, mark data, race documents, and GPS navigation features for yacht club racing.

3. Important Safety Notice

Navigation data provided by Race Marks is advisory only. The App is NOT a substitute for proper seamanship, official charts, or safety equipment. Users are solely responsible for their own safety at all times. Do not rely solely on this app for navigation decisions.

4. Accounts

You may optionally sign in via Apple or Google. You are responsible for maintaining the security of your account and for all activity that occurs under your account.

5. Subscriptions

Plans

• Season Pass (~€10/season) — per-club, per-season digital course cards
• Navigator (€39.99/yr) — live GPS navigation features, auto-renewing
• Tactician (€69.99/yr) — premium features, auto-renewing

Billing

• Auto-renewal — subscriptions are charged within 24 hours before the end of the current period
• Cancellation — cancel at least 24 hours before the renewal date via your App Store or Google Play account settings
• No refunds — no refunds are provided for partial subscription periods

6. Content

Course data is provided by yacht clubs. We do not guarantee the accuracy, completeness, or reliability of any course data. Clubs are responsible for the data they contribute.

7. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Scrape or systematically extract course data
• Redistribute course data without permission
• Use the App or its data for commercial purposes without written permission

8. Intellectual Property

The App, its design, and its content are © 2026 Digimill. All rights reserved. Club logos and names belong to their respective clubs and are used with permission.

9. Limitation of Liability

The App is provided "as is" without warranties of any kind, express or implied. Digimill is not liable for:

• Navigation errors or data inaccuracy
• Any loss, damage, or injury arising from use of the App
• Interruptions to service or loss of data

To the maximum extent permitted by law, our total liability is limited to the amount you have paid for the App in the 12 months preceding the claim.

10. Third-Party Services

The App uses third-party services including Firebase, RevenueCat, and LogRocket. Your use of these services is subject to their respective terms and conditions.

11. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms & Conditions.

12. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of Ireland.

13. Changes to These Terms

We may update these Terms & Conditions from time to time. Continued use of the App following any changes constitutes acceptance of the updated terms.
